Types of Product Liability Claims
In general, product liability injuries and their resulting personal injury claims fall into one of three accepted categories of legal case.
1. Defect of Manufacturing
Applies where the product is designed well, but its construction or assembly makes it unsafe; may involve loose parts, missing fasteners, etc.
2. Defect of Design
Applies where the overall design of the product is unsafe and therefore unreasonably dangerous; could apply to product packaging.
3. Insufficient Warning/Instruction
Applies where the product has no flaws or defects in and of itself, but does not include proper warnings or clear instructions for safe use.
