Signs of Birth Injuries

If complications are evident during pregnancy or labor, and if they are not responsibly addressed by a trained professional in a position to observe them, that negligence may be grounds for initiating a birth injury case. That is why it is important to be able to recognize signs of birth injury. Ask yourself these questions:

  • Does the newborn infant appear inert or floppy a few minutes after birth?
  • Have seizures developed in the first one or two days of life?
  • Has the newborn not yet cried after 10 or 15 minutes? (Would not apply when a breathing tube is inserted.)
  • Did it take a long time to resuscitate or awaken the newborn after delivery?

There are other, more specific warning signs that should not be taken for granted. These include low APGAR scores (5 or below at the five-minute test, 7 or below at the ten-minute test) or when a full-term baby is not able to go home when the mother is discharged.
